Who is responsible for soil and groundwater contamination caused by a leaking oil tank?

It does not matter whether the leakage occurred before or during your property ownership and occupancy. You, the owner, are ultimately responsible. You may be in a position to seek reimbursement for the costs of cleaning up soil or groundwater contamination from previous owners.
If you divest your property with a UST in place, whether or not it has been decommissioned, the discovery of contamination in the future could result in an environmental contamination claim being made against you.

What am I required to do about the unused underground storage tank?

Regulations require you to remove an unused underground storage tank. Please contact Nexxgen Environmental for assessment and potential options. We can work with you to develop a plan that suits your needs and budget without compromising any regulations and safety.

How do I know the underground storage tank is leaking?

Because they are buried, it is difficult to tell if an underground tank is leaking. Some underground tanks may leak for years without owners realizing it. If your oil consumption suddenly goes up, your tank may have sprung a large leak. We can come in and test if you have a leak and soil contamination.

When do aboveground tank need to be removed?

An existing aboveground fuel oil tank is considered approved, provided the tank was installed in accordance with the code at the time of installation. As long as the tank is not leaking, there is no age in which the tank must be replaced. Please call your fuel oil supplier or Nexxgen for inspection.
